Stepparent adoption vs. guardianship in Florida: What’s the difference?

What guardianship provides

Guardianship allows you to make important decisions for a child, such as handling medical care or school matters, without terminating the rights of biological parents.   • The adopting stepparent gains the same rights as a biological parent.
  • The child receives inheritance rights and can take the stepparent’s last name if desired.
  • The parental rights of the other biological parent (if they consent or if the court terminates them) are legally ended.
